COMERCIAL EDIZAR, S.A. has implemented ISO 9001 and 14001 quality standards as a benchmark in its activities, highlighting its commitment to quality. Therefore, this document describes the commitments and conditions regarding the supply of goods by COMERCIAL EDIZAR, S.A. as a result of all orders placed by its customers/buyers.

PRICES: The prices shown on our delivery notes and invoices are those agreed upon in our offers and do not include VAT or any other applicable taxes.

DELIVERY TIME: The delivery time will be as agreed in each order and should always be considered indicative. Therefore, COMERCIAL EDIZAR, S.A. will not be held liable in any case or under any circumstances for any delays that may occur, whether due to external causes or force majeure.

TRANSPORT OF GOODS: Goods are considered to be in the possession of the customer/buyer once they leave our warehouses, traveling at their own risk, even if shipped freight prepaid, regardless of the transport company used.

Goods will be shipped freight prepaid for orders over €600 within mainland Spain, except for Ceuta, Melilla, and the Canary Islands, where shipping costs will always be borne by the customer/buyer. If the customer wishes to collect the goods using their own means, they must handle the necessary arrangements.

RECEIPT OF GOODS: Goods are considered to be in accordance with the agreement unless the customer/buyer files a claim within 5 days of receipt. If any delivery is deemed defective due to hidden defects (not visually detectable), the customer shall only be entitled to replacement or order cancellation, excluding any other type of compensation.

QUALITY: COMERCIAL EDIZAR, S.A. undertakes to provide the customer with all technical information about the product through the Technical Data Sheet, as well as precautions regarding its use, storage, labeling, and packaging, via the Safety Data Sheet.

It is the user’s responsibility to determine the suitability of the products for their intended uses and applications, in accordance with current regulations (REACH and others), as well as the appropriateness of production and application methods. The user is solely responsible for the results. Appropriate tests must be conducted for the intended uses, including curing time and duration.

The user is also responsible for taking the recommended precautions to protect people and property from any risks associated with handling and using the products. COMERCIAL EDIZAR, S.A. specifically declines any liability for damages of any kind, whether incidental or consequential, resulting from the use of the products, including loss of profits.

RETURNS: If the delivered goods are considered defective, approval will be granted for their return and, as a consequence, either their replacement or order cancellation. If the returned goods, upon examination, are found to be defective due to misuse, poor storage, handling, etc., they will be sent back to the customer/buyer, and the corresponding invoice will be issued.

In cases where it is objectively proven that the supplied material is non-conforming, incorrect, etc., COMERCIAL EDIZAR, S.A. commits only to refunding or replacing the corresponding material.

PAYMENT: Invoicing and payment conditions must comply with the regulations in force at any given time.

The inclusion of payment terms in the invoice explicitly authorizes us to issue drafts to the bank stated therein.

Goods will remain the property of COMERCIAL EDIZAR, S.A. until full payment is received. In the event of delayed payment, COMERCIAL EDIZAR, S.A. reserves the right to suspend the supply of new orders or the commercial relationship, without waiving the right to claim damages and late payment interest.

WASTE: The holder of the final or used packaging waste is responsible for its proper environmental management, in accordance with current regulations.

OTHER INFORMATION: These general terms of sale are considered accepted by the buyer and will be included in all commercial offers. For any interpretation and/or application of these terms, both parties, by mutual agreement, submit to the Courts and Tribunals of the city of Zaragoza.

ORGANIC LAW ON DATA PROTECTION: In accordance with Organic Law 15/1999 on the Protection of Personal Data, we inform you that your personal data will be included in an automated file under the responsibility of COMERCIAL EDIZAR, S.A., for the purpose of fulfilling the commitments derived from the commercial relationship. You may exercise your rights of access, cancellation, rectification, and opposition by writing to Polígono de Malpica, C/F Oeste, Grupo Quejido, nave 64, 50016 Zaragoza. Unless otherwise notified, we will assume that your data has not been modified, that you agree to notify us of any changes, and that we have your consent to use it to maintain and strengthen the relationship between the parties.
